Terms of Service.

These terms are a contract between you and Alpha Numeric Multi-Media Ltd, trading as Made By Monolith, a company registered in England and Wales. By creating an account or buying anything, you accept them.

What we provide

Tools that turn artwork you supply into a 3D model, credits and figure allowances to use them, and optionally a printed copy of the result posted to you.

Your account

You must be 18 or over to buy. Keep your password to yourself; you are responsible for what happens under your account until you tell us it has been compromised.

We may suspend an account that breaches the Acceptable Use Policy. Where we do, we will refund any unused allowance unless the breach was fraudulent.

Credits and figure allowances

Allowances are a prepaid right to use the tools. They are not electronic money, they have no cash value, and they cannot be transferred or exchanged for money.

• Figure builds are spent when a 3D sculpt starts, not when it finishes. If a sculpt fails on our side or the supplier's, the allowance is returned automatically.
• Credits cover the 2D character work.
• Where a plan says allowances roll over, unused amounts carry into the next period. Where it says they do not, they reset on renewal — this is stated on the plan before you buy.
• If you close your account or we close it for a breach, unused allowances are lost, subject to your cancellation rights below.

Subscriptions

Plans renew automatically until cancelled. You can cancel at any time through your account; cancellation takes effect at the end of the period you have paid for, and you keep your access until then. We will tell you before any price change and you may cancel instead.

Your rights to cancel — consumer information

If you are a consumer in the UK or EU you normally have 14 days to change your mind about something bought online.

Digital content and services (credits, plans, generated models): when you buy, you are asked to agree that we may begin immediately and to acknowledge that you lose your 14-day right to cancel once we do. If you would rather keep the right, do not tick it and wait — but nothing will be delivered until you do.

Where allowances remain entirely unused, we will refund them within the 14 days regardless. We would rather be generous than argumentative about this.

Printed figures: these are made to your specification and are therefore exempt from the 14-day right under the Consumer Contracts Regulations. You can cancel free of charge until we begin preparing the model — the status shown on your order tells you where it is. After that we cannot cancel it, because it cannot be sold to anyone else.

None of this affects your legal rights if something arrives faulty, damaged, or not as described. Then you are entitled to a repair, replacement or refund under the Consumer Rights Act 2015.

Delivery

We aim to post printed figures within 10 working days of the order, and will tell you as the build moves along. Risk passes to you on delivery.

What you own, and what we own

You keep the rights to the artwork you upload, and you must have the right to upload it. You grant us a licence to use it only to provide the service — storing it, sending it to our processors, and producing your model.

You own the model produced from your artwork, on the terms in the AI Content Licence.

We own the tools, the website and everything in them.

Availability

We try to keep everything running but do not promise it will be uninterrupted. This is a beta service and features may change.

Our liability

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Otherwise, and to the extent the law allows, our total liability to you is limited to what you paid us in the 12 months before the claim. We are not liable for loss of profit, loss of business, or loss of data where you had the ability to keep your own copy.

If you are a consumer, we are not liable for business losses.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the UK or the EU, you keep the benefit of any mandatory protections of your own country's law, and may bring proceedings there.
